General:

If you place an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and the distance sales agreement presented to you.

With regard to the sale and delivery of the products they purchase, Buyers are subject to the provisions of 6502 sayılı Tüketicinin Korunması Hakkında Kanun (Law No. 6502 on Consumer Protection) and Mesafeli Sözleşmeler Yönetmeliği (Regulation on Distance Contracts) (Official Gazette: 27.11.2014/29188) and to other applicable laws.

Shipping charges, being the cost of dispatching the product, shall be paid by the buyers.

Each product purchased is delivered to the person and/or organisation at the address indicated by the buyer, provided that the 30-day legal period is not exceeded. If the product is not delivered within this period, Buyers may terminate the agreement.

The purchased product must be delivered complete, in conformity with the characteristics specified in the order and, if applicable, together with documents such as the warranty certificate and user manual.

If the sale of the purchased product becomes impossible, the seller must notify the buyer of this in writing within 3 days of becoming aware of it. The total price must also be refunded to the Buyer within 14 days.

If the price of the purchased product is not paid:

If the Buyer does not pay the price of the purchased product or cancels it in bank records, the Seller's obligation to deliver the product ends.

Purchases made through unauthorised use of a credit card:

If, after the product has been delivered, it is established that the credit card used by the buyer for payment was unlawfully used by unauthorised persons, and the price of the product sold is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product subject to the agreement to the SELLER within 3 days, with the shipping costs borne by the SELLER.

If the product cannot be delivered on time for unforeseeable reasons:

If force majeure events that the Seller could not foresee occur and the product cannot be delivered on time, the Buyer is notified. The Buyer may request cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the obstacle is removed. If the Buyer cancels the order and paid in cash, this amount is paid back to the Buyer in cash within 14 days of the cancellation. If the Buyer paid by credit card and cancels, the price of the product is likewise refunded to the bank within 14 days of the cancellation; however, it may take 2-3 weeks for the bank to transfer it to the buyer's account.

The buyer's obligation to inspect the product:

The Buyer shall inspect the goods/service subject to the agreement before taking delivery and shall not accept from the shipping company any damaged or defective goods/service, such as dented or broken items or items with torn packaging. Goods/services received shall be deemed undamaged and intact. The BUYER must carefully protect the goods/service after delivery. If the right of withdrawal is to be exercised, the goods/service must not be used. The invoice must also be returned together with the product.

Right of withdrawal:

The BUYER may exercise the right to withdraw from the agreement by rejecting the goods, without assuming any legal or criminal liability and without giving any reason, within 14 (fourteen) days of the date of delivery of the purchased product to the BUYER or to the person/organisation at the address indicated by the BUYER, provided that the SELLER is notified via the contact details below.

Withdrawal period:

If what the Buyer has purchased is a service, this 14-day period starts from the date on which the agreement is signed. The right of withdrawal cannot be exercised for service contracts whose performance has begun with the consumer's consent before the end of the withdrawal period.

Costs arising from the exercise of the right of withdrawal are borne by the SELLER.

To exercise the right of withdrawal, written notice must be given to the SELLER within the 14 (fourteen) day period by registered mail with return receipt, fax or e-mail, and the product must not have been used, in accordance with the provisions on "Products for Which the Right of Withdrawal Cannot Be Exercised" set out in this agreement.

Exercising the right of withdrawal:

  • The invoice of the product delivered to a third party or to the BUYER (if the invoice of the product to be returned is issued to a company, the product must be sent back together with a return invoice issued by that company. Returns of orders invoiced in the name of companies cannot be completed unless a RETURN INVOICE is issued.)
  • The return form; the products to be returned must be delivered complete and undamaged, together with their box, packaging and standard accessories, if any.

Return conditions:

The SELLER is obliged to refund the total price to the BUYER and return any documents placing the BUYER under a debt within 10 days at the latest of receipt of the notice of withdrawal, and to take back the goods within 20 days.

If the value of the goods decreases or their return becomes impossible for a reason attributable to the fault of the BUYER, the BUYER is obliged to compensate the SELLER's losses in proportion to the BUYER's fault. However, the BUYER is not liable for changes and deterioration resulting from the proper use of the goods or product within the withdrawal period.

If, as a result of the exercise of the right of withdrawal, the amount falls below the campaign limit set by the SELLER, the discount obtained under the campaign is cancelled.

Products for which the right of withdrawal cannot be exercised:

Under the Regulation, returns are not possible for: products prepared at the request of the BUYER or clearly in line with the BUYER's personal needs that are not suitable for return; underwear bottoms, swimsuit and bikini bottoms; make-up products; single-use products; goods at risk of rapid deterioration or likely to pass their expiry date; products whose return is unsuitable in terms of health and hygiene if their packaging has been opened by the BUYER after delivery; products that become mixed with other products after delivery and by their nature cannot be separated; goods relating to periodicals such as newspapers and magazines, other than those supplied under a subscription agreement; services performed instantly in electronic media or intangible goods delivered instantly to the consumer; and audio or video recordings, books, digital content, software programs, data recording and data storage devices and computer consumables, if their packaging has been opened by the BUYER. In addition, under the Regulation the right of withdrawal cannot be exercised for services whose performance has begun with the consumer's consent before the end of the withdrawal period.

In order for cosmetics and personal care products, underwear, swimsuits, bikinis, books, copyable software and programs, DVDs, VCDs, CDs and cassettes, and stationery consumables (toner, cartridges, ribbons, etc.) to be returned, their packaging must be unopened and the products must be untried, intact and unused.

The BUYER accepts, declares and undertakes that, if the BUYER defaults where payments are made by credit card, the BUYER will pay interest under the credit card agreement with the card-issuing bank and will be liable to the bank. In this case, the relevant bank may resort to legal remedies and may claim the resulting costs and attorney's fees from the BUYER, and in any event, if the BUYER defaults on its debt, the BUYER agrees to pay for the loss and damage suffered by the SELLER as a result of the late performance of the debt.
