Distance Sales Agreement

By accepting this agreement, the BUYER accepts in advance that, if the BUYER confirms the order that is the subject of the agreement, the BUYER will be under the obligation to pay the price of the order and any additional charges specified, such as shipping fees and taxes, if any, and that the BUYER has been informed of this.

2. Definitions

In the application and interpretation of this agreement, the terms written below shall have the meanings set out against them.

• MINISTER: the Minister of Customs and Trade,
• MINISTRY: the Ministry of Customs and Trade,
• LAW: 6502 sayılı Tüketicinin Korunması Hakkında Kanun (Law No. 6502 on Consumer Protection),
• REGULATION: Mesafeli Sözleşmeler Yönetmeliği (Regulation on Distance Contracts),
• SERVICE: any consumer transaction, other than the supply of goods, that is performed or undertaken to be performed in return for a fee or benefit,
• SELLER: the company that offers goods to the consumer within the scope of its commercial or professional activities, or that acts on behalf of or for the account of the party offering goods,
• BUYER: the natural or legal person who acquires, uses or benefits from goods or services for non-commercial or non-professional purposes,
• SITE: the website belonging to the SELLER,
• ORDERING PARTY: the natural or legal person who requests goods or services through the website belonging to the SELLER,
• PARTIES: the SELLER and the BUYER,
• AGREEMENT: this agreement concluded between the SELLER and the BUYER,
• GOODS: the movable property that is the subject of the purchase, and intangible goods such as software, audio, video and similar items prepared for use in electronic media.

3. Subject

This Agreement governs the rights and obligations of the parties, in accordance with the provisions of 6502 sayılı Tüketicinin Korunması Hakkında Kanun and Mesafeli Sözleşmelere Dair Yönetmelik (Regulation on Distance Contracts), in connection with the sale and delivery of the product, whose characteristics and sales price are specified below, ordered electronically by the BUYER through the website belonging to the SELLER.

The prices listed and announced on the site are sales prices. Announced prices and promises remain valid until they are updated or changed. Prices announced for a limited period remain valid until the end of the specified period.

7. Information on the product(s) subject to the agreement

7.1. Product Features

The basic characteristics of the goods/product/products/service (type, quantity, brand/model, colour, number of units) are published on the website belonging to the SELLER. If the Seller has organised a campaign, you can review the basic characteristics of the relevant product during the campaign period. Valid until the campaign date.

7.2. Prices

The prices listed and announced on the site are sales prices. Announced prices and promises remain valid until they are updated or changed. Prices announced for a limited period remain valid until the end of the specified period.

7.3. Taxes and Payments

The sales price of the goods or service subject to the agreement, including all taxes, is shown below.

Invoice Delivery: The invoice will be delivered to the billing address together with the order at the time of delivery of the order.

9. General provisions

9.1. Information and Acceptance

The BUYER accepts, declares and undertakes that the BUYER has read and been informed of the preliminary information on the website belonging to the SELLER regarding the basic characteristics, sales price and method of payment of the product subject to the agreement, and regarding delivery, and has given the necessary confirmation electronically.

9.2. Delivery Period

Each product subject to the agreement is delivered within the period specified in the preliminary information section of the website, depending on the distance of the BUYER's place of residence, provided that the 30-day legal period is not exceeded.

10. Right of withdrawal

Where the distance agreement relates to the sale of goods, the BUYER may exercise the right to withdraw from the agreement by rejecting the goods, without giving any reason, within 14 days of the date of delivery of the product to the BUYER or to the person/organisation at the address indicated by the BUYER, provided that the SELLER is notified.

11. Products for which the right of withdrawal cannot be exercised

Products prepared at the request of the BUYER or clearly in line with the BUYER's personal needs, such as underwear bottoms, make-up products and single-use products, are excluded from the scope of the right of withdrawal.

12. Default and its legal consequences

The BUYER accepts, declares and undertakes that, if the BUYER defaults where payments are made by credit card, the BUYER will pay interest under the credit card agreement with the card-issuing bank and will be liable to the bank.

13. Competent court

Complaints and objections in disputes arising from this agreement shall be submitted to the consumer arbitration committee or the consumer court at the consumer's place of residence or at the place where the consumer transaction was carried out.

14. Entry into force

The BUYER shall be deemed to have accepted all the terms of this agreement upon making the payment for the order placed through the Site.
